If someone calls fire department, as intimidation, do u have any defenses?
While maddening as it were, there is nothing illegal either for a 'concerned citizen' to call on his 'new' neighbor. This person, as annoying as they may be for putting their nose into other people's business, has done nothing illegal. The fact that he called a public agency who came out and investigated is proof of this legality. The real issue here is whether an annoying neighbor who purports connections with public agencies and threatens to call this person and that person to check on 'illegal' activities or other 'suspicious' activities is doing so in an illegal manner. Falsely reporting to a public agency to effect action or purview is a misdemeanor. The crux of the issue rests on whether the person 'damaged' by said actions decides to bring a civil suit against the original false reporter or files a police report against the false reporter. In this case, if the facts of the initial call to the fire department are known to be falsified to effect action on the part of the fire department to come out and conduct and inspection, then this neighbor could file a police report against the other neighbor for a call-out based on false facts. Then it becomes a he-said/she-said situation and unless the call was made to the station on a recorded line which the offended neighbor could cite in a police report against the 'annoying' neighbor, then there is no issue to which can argued and everyone is going to have to learn to get along or get more educated in how to deal with nosy neighbors. Fight fire with fire.
